Fair Debt Collection : Both state and federal laws protect consumers’ rights when a someone is seeking to collect on a debt.  We bring cases to stop debt collector abuse and seek compensation for you when a debt collector oversteps his or her bounds in the process of collection.  Our years of experience will help protect your rights and stop debtor harassment.  

Truth-in-Lending : Every time a consumer borrows money or enters into a car lease, the lender is obligated under federal regulations to provide you with certain information.  Failure to provide such information can constitute a breach of the lender’s obligations under the contract.  We have spent forty-one years litigating Truth-In-Lending cases and have litigated leading cases.

When you refinance your mortgage, you have additional rights. These Truth-In-Lending rights may enable you to rescind the mortgage transaction. 

Wrongful Foreclosure : In a foreclosure, you, the consumer, have rights. In Georgia, you have a right to a written notice of your foreclosure date. The lender must advertise your property four times before foreclosure, and foreclosure can only happen on the first Tuesday of every month. The party foreclosing on your property is obligated to follow these specific guidelines, and others, in the foreclosure process.  Failure to follow those guidelines is a violation of your rights and a wrongful foreclosure.  It is also a violation of the Fair Debt Collection Practices Act, a federal law which protects consumers.

Mortgage Violations : Mortgage companies may violate terms of a mortgage agreement which may not result in foreclosure, but in which you need representation.  We have experience in this type of representation.
